What's actually at stake

Each day can count separately
DSHS may assess administrative penalties of up to $5,000, and under 25 TAC §229.412 each day of a continuing violation can be treated as a separate violation. Operating unlicensed is treated the same way.
Records are the inspection
Sterilization logs, monthly spore-test results, and client files are what an inspector asks for first — and they have to be retained (at least two years for sterilization logs and client records).
OSHA applies once you have staff
Federal OSHA maximums, effective January 15, 2026: $16,550 per serious violation and $165,514 per willful or repeated violation. Texas has no state OSHA plan for private employers, so these apply directly.

Questions tattoo studio owners ask
How often do sterilizers need spore testing?
Every calendar month, through an approved laboratory, with the results retained for inspection (25 TAC §229.407). The Kit includes the monthly log.
What has to be in a client record?
The service and body location, ink colors with manufacturer and lot detail, the artist, aftercare acknowledgment, and the client's signature — kept at least two years. The Kit's consent form captures all of it in one page.
Can I tattoo someone under 18?
Texas allows tattooing a minor only in a narrow cover-up circumstance with parental consent; piercings require written, notarized parental consent with presence or affidavit. The Kit includes both forms so the file is complete.
I'm a solo artist with no employees. Does OSHA apply?
The federal bloodborne pathogens standard is an employer obligation, so a true solo operator isn't covered as an employer — but DSHS rules still require universal precautions and sanitation. The Kit covers the DSHS side either way and includes the OSHA set for when you hire.
Do I need a separate license for piercing?
Your DSHS license has to cover the services you actually offer — tattoo, piercing, or both. The license tracker makes the match explicit.
Is human trafficking training really required now?
Yes. HB 1778 added Health & Safety Code §146.0075 in 2025, and it requires every employee of a tattoo or body piercing studio to complete a state-approved human trafficking prevention course. No employee could be required to finish one before January 1, 2026, so this is a new obligation most studios have not documented yet. HHSC approves the courses and at least one is free, and the department posts the approved list. Studios also have to post the human trafficking signs required by Government Code §402.0351.
